Law SB-4D & SB154

Legislation surrounding Florida’s mandatory
milestone inspections focuses on identifying
“substantial structural deterioration,” such as
significant weaknesses or distress in the building’s structure (excluding surface imperfections).

Buildings of three stories or higher will need
inspections, based on factors like age and proximity to saltwater. Condominium buildings constructed before July 1992 must undergo a milestone inspection by December 31, 2024.
These inspections are essential for ensuring the
safety and structural integrity of our properties.
We’ll provide more details and updates as we move forward.

Specifically, SB 154 revises requirements for
milestone inspections in residential condominium and cooperative buildings. It clarifies responsibility, sets deadlines, and offers exemptions. It also addresses governance, reserve funding, and turnover inspection reports. The law establishes a building safety program and exempts unit owner policies from flood coverage requirements. Additionally, it includes provisions for presale disclosures, and an appropriation for implementation. The law’s effective date is upon becoming law, subject to gubernatorial approval or without the Governor’s signature. View the law in entirety here.
